Now I have the details of the alleged crime. The dealer states that she and her husband came in together, and the car was delivered, registered in her name. But she had represeted (and signed papers) to the effect that she would come in THE NEXT DAY and pay the $17,000 in full. The whole case hinges n the dealer's opinion that she had no reason to believe that the husband would make the payment for the car, and therefore she defrauded the dealership. Notwithstanding the fact that a simple credit check on her would reveal that she had no income for the past two years, no credit cards, no assets, no bank account, and and was completely uncreditworthy, and a co-signer was arranged against default.

The dealer is alleging that the car was obtained through HER fraud, because she had no reasonable expectations that the co-signer would pay for it out of their joint marital assets, which he had full control of, even though such a commitment was made by the parties at the point of sale, in the presence of the dealer. The payment in full was to be paid on June 6. What the dealer did not tell the police was that from that date through August 1, the car was parked at the address shown on the registration certificate, and the dealer made no effort to repossess the vehicle, nor to contact either signatory to enquire about payment for the vehicle. She had no way of knowing that payments were not being made as promised, and she made no effort to conceal either herself or the car. For this, she got to spend 7 days in the county jail.

Next court date is set for September 10.

So, now you know. If your kid buys his first car, and you co-sign for it, your kid could spend a week in jail, with bail set at $30,000, charged with a class-2 felony, without anybody ever warning you that a payment is late, and without ever going to his house to see if they can get the car, and without ever sending him a notice that a payment is late.

The plot is beginning to thicken. The husband is expected today or tomorrow to take delivery of another car, from another dealer, with another woman being represented as his wife, for whom he is cosigning.
